Terms of Service

1. Who can use the Service

• You must be legally capable of forming a binding contract. If you are under the age of majority in your jurisdiction, you may use the Service only with the consent and supervision of a parent or legal guardian.
• You are responsible for your account security, including safeguarding passwords, tokens, API keys, and session credentials.

2. Changes to the Service or these Terms

We may modify the Service or these Terms from time to time. We will post updates with a new Effective Date. Your continued use of the Service after the update means you accept the changes.

3. Strictly prohibited content and conduct

To protect users and comply with applicable law, you must not upload, enter, generate, share, or distribute any of the following (including prompts, images, text, or links):

1. Pornographic or sexually explicit content, including sexual exploitation, explicit nudity, or sexual content involving minors;
2. Violent or gory content, promotion of terrorism, incitement to violence, self-harm encouragement, or depiction intended to shock or disgust;
3. Violations of portrait/publicity rights, privacy, or reputation: using any real person's identifiable likeness (including public figures and minors) without prior, explicit permission; deepfakes intended to mislead or defraud;
4. Intellectual property infringement, including unauthorized use of copyrighted works, trademarks, or patents;
5. Unlawful or harmful activities, including fraud, harassment, malware, phishing, spamming, scraping, denial-of-service, or attempts to bypass security or rate limits;
6. Hate or harassment targeting protected classes or individuals on the basis of race, ethnicity, religion, gender, sexual orientation, disability, nationality, etc.;
7. Any content or behavior that violates these Terms or generally accepted standards of decency.

We may remove content, limit access, or suspend/terminate accounts without prior notice for violations, and may notify or cooperate with competent authorities when required by law.

4. User content and generated content

4.1 Your uploads ("User Content")

You retain ownership of your User Content. You grant us a worldwide, non-exclusive, royalty-free license to host, process, transmit, and display your User Content solely to operate, protect, and improve the Service (including automated safety checks, abuse prevention, and legal compliance).

4.2 Generated outputs ("Generated Content")

4.3 Public figures and minors

Do not generate or distribute identifiable depictions of real persons (including public figures and minors) without verifiable consent. Absolutely no sexualized content involving minors.

5. Payments, subscriptions, refunds, and cancellations

5.1 Payment Processing

All payments are processed by Creem.io, our third-party payment processor. We do not store your payment card details. Creem.io handles all payment data securely in compliance with industry standards.

5.2 Subscription Plans

• Monthly Plans: Automatically renew every 30 days
• Annual Plans: Automatically renew every 12 months
• Credit Packs: One-time purchases; credits never expire
• You authorize recurring charges until you cancel

5.3 Refund Policy

5.4 Cancellation

Cancel anytime via your Dashboard → Billing → Manage Subscription, or email us.

• No future charges after cancellation
• Keep access until end of paid period
• Your account and unused credits remain accessible as long as your account is active
• Account data may be deleted after 90 days of inactivity (no login)

5.5 Pricing & Taxes

• Prices may change with 30 days notice to existing subscribers
• Taxes calculated based on your location
• Cancel before renewal if you don't accept price changes

5.6 Failed Payments

• We retry up to 3 times over 7 days
• Account suspended if payment fails; reactivate by updating payment method
• Data preserved for 30 days during suspension

5.7 Chargebacks & Fraud

Initiating chargebacks without contacting us first, or fraudulent activity, may result in immediate account termination.

5.8 Consumer Rights

This policy does not limit any statutory consumer rights you may have under applicable law (e.g., EU Consumer Rights Directive, UK Consumer Rights Act).

6. Fair use, rate limits, and security

Do not scrape, crawl, mirror, or attempt to bypass access controls or rate limits. Do not reverse engineer, probe, or interfere with the Service or its providers. We may enforce peraccount/IP/device quotas to protect service quality and safety.

7. Thirdparty services and models

The Service may rely on thirdparty models, cloud infrastructure, analytics, and other providers. Availability, quality, and constraints may change at any time. AI outputs can be unpredictable and may contain inaccuracies, bias, or content you find objectionable. You should independently review and verify outputs for your intended use.

8. Intellectual property; feedback

We and our licensors own all rights in the Service (software, models, algorithms, UI/UX, and content not provided by you). If you provide feedback or suggestions, you grant us a free, transferable, sublicensable, irrevocable license to use them for any purpose.

9. Notice-and-takedown (IP/portrait/privacy)

If you believe content on the Service infringes your rights (including portrait/publicity rights or copyright), email support@nano2image.com with: (a) your identity and contact details; (b) the exact URL or identifier of the allegedly infringing content; (c) proof of rights or authorization; and (d) a signed statement of accuracy and good faith. We will review and act as appropriate.

10. Disclaimers

The Service is provided "AS IS" and "AS AVAILABLE", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, noninfringement, and uninterrupted operation.

11. Limitation of liability

To the maximum extent permitted by law, we will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or any loss of profits, data, goodwill, or business interruption. Our total aggregate liability for claims arising out of or relating to the Service will not exceed the amounts you paid to us for the Service in the 12 months preceding the claim.

12. Indemnification

You will defend, indemnify, and hold us harmless from any claims, losses, or expenses (including reasonable attorneys' fees) arising from your use of the Service, your content, or your violation of these Terms or applicable law.

13. Suspension and termination

We may suspend or terminate your access to the Service at any time if we reasonably believe you violated these Terms, risk the security or operation of the Service, or engage in unlawful acts. You may stop using the Service at any time.
